2. The petitioner apprehends his arrest in connection with Dhanha P.S. Case No. 70 of 2025, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.
3. There is recovery of 3 litres of foreign liquor from a Mahindra TUV 300 Car bearing Registration No. BR22X 0002. Driver of the vehicle was apprehended on the spot.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case being registered owner of the vehicle in question. The driver of the vehicle was apprehended on the spot who himself disclosed that he was taking the said liquor for his consumption.
Patna High Court CR. MISC. No.42154 of 2025(4) dt.13-10-2025 2/2 Petitioner has no concern with the seized liquor. Petitioner has no criminal antecedent. He undertakes to co-operate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the Petitioner, above-named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-I, Bagha, West Champaran in connection with Dhanha P.S. Case No. 70 of 2025, subject to the conditions laid down in Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
