No doubt, 300 litres illegal country-made liquor were recovered from the tempo of the petitioner but according to prosecution case itself, the seized country-made liquor was being carried by another person, who managed to escape when his tempo was intercepted. Petitioner appears to be driver of the aforesaid tempo.

Considering the aforesaid facts and circumstances as well as submission of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.25934 of 2015 (2) dt.23-07-2015 2/2 amount each in connection with Chandi P.S. Case No. 35 of 2015 to the satisfaction of Shri Akhilesh Kumar Pandey, Judicial Magistrate-Ist Class, Bhojpur at Ara.
