====================================================== CORAM: HONOURABLE MR. JUSTICE V. NATH ORAL ORDER 19-05-2017 Mr. R.S. Pradhan, learned Senior Counsel appearing on behalf of appellant, after some arguments, prays to withdraw this application. It has also been submitted that the appeal is pending at the instance of tenant since 2002 and, therefore, a direction be issued for expeditious disposal.

The prayer for withdrawing this application is allowed and this application is dismissed as withdrawn.

Learned Court below is further directed to dispose of the appeal, preferably within six weeks, from the date of production/receipt of a copy of this order and the petitioner is also set at liberty to make prayer for early disposal of the appeal in accordance with law. The parties to this application are enjoyed to co-operate in disposal of the appeal within the aforesaid time frame and the learned Court below is directed to proceed in accordance with the provisions of C.P.C., if any of the parties to the appeal adopts dilatory tactics.
