====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2020 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Special Case No. 310 of 2020 arising out of Kursakanta (Kuari) P.S. Case No. 52 of 2020, dated 10.03.2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

There is stated to be recovery of 41.400 litres of

Patna High Court CR. MISC. No.33396 of 2020(2) dt.14-12-2020 2/2 Nepali liquor.

Learned counsel for the petitioner submits that the aforesaid recovery has wrongly been saddled upon him. The petitioner is in custody since 11.03.2020 and he claims to be a person of clean antecedents. Considering the facts afore-stated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-CumSpecial Judge, Araria in connection with Special Case No. 310 of 2020 arising out of Kursakanta (Kuari) P.S. Case No. 52 of 2020.
