2. The petitioner apprehends his arrest in Chakia P.S. Case No. 478 of 2025 registered under Section 303(2) of B.N.S.
3. As per the prosecution story which has been lodged on the basis of written report submitted by the informant to the effect that on the alleged date of occurrence i.e 23.8.25, at around 8:00 am, while he went for check up his bike which was parked near Gandhi Maidan Gate, was stolen by some unknown persons.
3. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed the offence. The name of the petitioner has transpired during course of investigation, on the basis of confessional statement made by the co-accused Abhishek Kumar. No evidence has come against the petitioner and he is not involved in the present case. He submits that during the course of investigation,

No.34062 of 2026(2) dt.18-05-2026 2/3 the stolen motorcycle was recovered from the garage of Bhola Mistri and the said Bhola Mistri gave his statement to the effect that the motorcycle was given by co-accused Abhishek Kumar for servicing. On the basis of the statement made by the co-accused Abhishek Kumar, the name of the petitioner transpired in the present case. He submits that the petitioner is an accused in three other cases, however, in all the three cases, he is on bail.
4. The Learned APP for the State opposes the prayer for anticipatory bail of the petitioner and submits that the petitioner is a hardcore criminal having three antecedents of different nature and therefore, he does not deserve the privilege of anticipatory bail.

Having heard the learned counsel for the parties and after going through the records, it appears that the first information report was lodged against unknown and during course of investigation, the stolen motorcycle was recovered from the garage of Bhola Mistri. On the basis of confessional statement made by said Bhola Mistri, the name of the co-accused Abhishek Kumar transpired and on the basis of statement made by the co-accused Abhishek Kumar, the name of the present petitioner transpired. The petitioner was not present at the place of occurrence and further the looted motorcycle has not been recovered from the possession of the petitioner.
6. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be

No.34062 of 2026(2) dt.18-05-2026 3/3 released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, East Champaran, Motihari in connection with Chakia P.S. Case No. 478 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., with further condition:
(I) The learned Court concerned shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedents, the Court concerned shall take steps for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above mentioned order shall not be delayed for purpose of or in the name of verification.
