The petitioner is languishing in custody since 27.03.2015 in a case registered for the offences punishable under section 394 of the Indian Penal Code and 25 (1-B)a/26/35 of the Arms Act.

Informant's eleven thousand rupees, one mobile and some documents were robbed leading to the registration of FIR against unknown. The name of the petitioner transpired in confession of co-accused Sunil Chaudhary. Statement has been made in para 6 of the petition that neither there is any recovery from the petitioner nor he has been put on Test Identification Parade. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Moreover, the

Patna High Court Cr.Misc. No.25712 of 2015 (2) dt.23-07-2015 2/2 investigation has already concluded.

Considering the fact that investigation has already concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Chautarwa (Bhairoganj) P.S. Case No.38 of 2015.
