2. The petitioner apprehends his arrest in connection with Complaint Case No. 1683 of 2016, registered for the offences punishable under Section 420 of the Indian Penal Code.

3. According to allegation, the informant purchased a piece of land from co-accused Madheshwar Sharma on 28.03.2014. The name of the informant was mutated over that land, but receipt was not issued. He came to know that prior to purchase of the land, co-accused Madheshwar Sharma had already sold that land to another person.

4. The learned counsel for the petitioner has submitted that the allegation against the petitioner, who is the Circle Officer, is

Paragraph no. 11 of the complaint petition shows that the name of the informant was mutated prior to 05.12.2014 and on that date, the petitioner was not posted in the Phulwarisharif Circle. He was posted there in the year 2015.

5. On the other hand, learned counsel for the informant has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Patna in connection with Complaint Case No. 1683 of 2016, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.
