====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Vigilance P.S. Case No. 68 of 2017 registered under Sections 420, 467, 468, 471, 193, 196, 197, 199 and 120(B) of the Indian Penal Code and Section 13(2) read with Section 13(1) (d) of the P.C. Act, pending in the court of Special Judge, Vigilance Ist, Patna.
The accusation is that C.W.J.C. No. 3148 of 2017 was filed by Nilam Kumari, Renu Kumari, Manoranjan Kumar (petitioner), Sanjiv Nayan and Promod Rangrajan and C.W.J.C. No. 3356 of 2017 was filed by one Chandu Kumari with contention that they had applied for selection to the post of
Patna High Court CR. MISC. No.73844 of 2018(5) dt.29-04-2019 2/3 Panchayat Teachers in second phase of 2008 in Panchayat Raj, Adampur, and Panchayat Raj, Pokharpur. While their name were shown in the final selection list but in spite of that, they were not selected. Thereafter, Appeal Case No. 28 of 2016 and Appeal Case No. 01 of 2016 were filed before the District Education Tribunal, Nalanda, for their appointment, in which, orders were also passed on 26.04.2016 and 30.06.2016, respectively, in spite of that they were not selected. During pendency of aforesaid writ applications, direction was given by this Hon'ble Court for inquiry, in which, it was detected that all the aforesaid writ petitioners including the petitioner of prsent case had not applied for the post of Panchayat Teachers in second phase selection of year 2008 in Panchayat Raj, Adampur and Panchayat Raj, Pokharpur and both the orders of aforesaid appeals were forged. Thereafter, direction was given by this Hon'ble High Court to lodge the case. Accordingly, the present case has been lodged.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to allow the privilege of pre-arrest bail to the petitioner. Accordingly, his prayer for grant of pre-arrest bail stands rejected. The petitioner is directed to surrender before the
Patna High Court CR. MISC. No.73844 of 2018(5) dt.29-04-2019 3/3 trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
