The petitioner is in custody in connection with Bheldi P.S. Case No.218 of 2018 for the offences under Sections 341, 323, 324, 325, 307, 504, 506, 34 and 302 of the Indian Penal Code.

Allegation against the petitioner is of assaulting with iron rod on the head of informant.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He has been falsely implicated in this case for the reason that a partition suit is running between the parties. Petitioner is in custody since 04.07.2018.

Patna High Court CR. MISC. No.34154 of 2019(2) dt.27-05-2019 2/2 Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected. However, after completing one year of the custody, the petitioner would be at liberty to renew his prayer for grant of bail.
