The petitioner seeks bail in a case for the offences punishable under sections 304B, 201/34 of the I.P.C Mamta Devi, daughter of the informant, was married with the petitioner in the year 2007 and due to non fulfillment of demand of motorcycle she was done to death and her dead body has also been made traceless.

Submission is of false implication and that the deceased died due to diarrhea and she was treated by local doctor who referred to P.M.C.H vide Annexure-2 and the petitioner without any fault is suffering in custody since 05.08.2014 and as

Patna High Court Cr.Misc. No.25865 of 2015 (3) dt.09-10-2015 2/2 such the petitioner deserves sympathetic consideration, to which the learned A.P.P. opposes by submitting that the witnesses have supported the allegation vide paragraphs- 6, 7, 8 and 9 of the case diary.

In the facts and circumstances as stated above, considering the allegation attributed against the petitioner serious in nature, this Court is not inclined to enlarge the petitioner on bail at this stage and accordingly his such prayer stands rejected in connection with Bhagawanpur P.S. Case No. 64 of 2014 pending in the court of J.M. 1st Class, Hajipur, Vaishali. However, the trial court is directed to expedite the trial by taking the same on priority basis and to conclude the same preferably within six months.
