The petitioner apprehends his arrest in Sheo Sagar P.S. Case No.22 of 2021, registered for the offences punishable under Section 420 of the Indian Penal Code and Section 7(1)(a) (I) and FCO3(3) of the Essential Commodities Act.
The case of the prosecution is based upon the written petition filed by Satendra Narayan Singh, Block Development Officer, Sheosagar in which he has stated that in the light of letter No.129 dated 11.01.2021 issued by the District Magistrate, Rohtas, Md. Rijarwar Firdaus Quaraishi, Additional Sub-divisional Officer inquired on 13.01.2021 and submitted his inquiry report through letter no.101/Conf. Dated 15.01.2021 in which he has found irregularities committed by the proprietor Dablu bablu
Patna High Court CR. MISC. No.44306 of 2021(2) dt.15-04-2022 2/2 Fertilizer Store Karup namely Dharmendra Kumar. It is further stated that Mithilesh Kumar of Gram Pipri has received only 8 bags of fertilizer instead of 71 bags.
Learned Senior Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that from perusal of the impugned order, it is clear that Mithilesh Kumar has further filed a petition before the learned court below that he has received 71 bags of fertilizer.
Taking into consideration the fact that Mithilesh Kumar filed a petition before the learned court below that he has received 71 bags of fertilizer, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sasaram, Rohtas in connection with Sheo Sagar P.S.
