JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Section-307 & other minor sections of the Indian Penal Code, Section-27 of the Arms Act and Section-3/4 of Explosive Substances Act.

Petitioner No. 1 is said to have hurled bomb whereas; petitioner No. 2 is said to have opened fire but admittedly, neither the informant nor any other person sustained injury, either caused by bomb or fire-arms. So far as petitioner No. 3 is concerned; no specific overt act has been attributed against him. Moreover, coaccused namely, Vinay Kapri and Vivek Kapri, against whom,

Taking note of aforesaid facts and circumstances as well as this aspect of the matter that petitioners do not have any criminal antecedent, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Amarpur P.S. Case No. 231 of 2015 to the satisfaction of learned Chief Judicial Magistrate Banka.
