JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioner seeks regular bail in connection with Kudhani (Turki O.P.) P.S. Case No.609 of 2018 registered for the offences punishable under Sections 399, 402, 120(B) of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.

Allegation as per F.I.R. is of recovery of one country made pistol with one live cartridge and it further appears that petitioner is involved in nine other cases.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and another coaccused has been granted bail by a Co-ordinate Bench of this Court vide order dated 29.03.2019 passed in Criminal Misc. No.19307 of 2019 and petitioner is in custody since 13.12.2018. Heard learned A.P.P. also.

Patna High Court CR. MISC. No.33484 of 2019(2) dt.21-05-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage. However, learned trial court is directed to expedite the trial of this case.

With the above observations, this application is dismissed.
