The petitioner is in custody in a case registered under Sections 25(1-B)A/26 of the Arms Act.
The prosecution case, in brief, is that while the informant and his associates were on patrolling duty on 29.3.2015 on a tip-off that some miscreants were gathered for sale and purchase of arms at Lichi Bagan situated at AsatpurSatpura, they reached the said place and apprehended some persons. One country-made pistol was recovered from the possession of the petitioner and from the pocket of one Birju Kumar, one mobile has been recovered.
On behalf of the petitioner, it has been submitted that
Patna High Court Cr.Misc. No.26096 of 2015 (2) dt.27-07-2015 2/2 the petitioner is in custody since 30.3.2015 and he has no criminal antecedents. It is further submitted that one countrymade pistol is alleged to have been recovered from the possession of the petitioner.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali, in connection with Bhagwanpur P.S. Case No.50 of 2015 (G.R. No.1459/15).
