JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 The petitioner is in custody since 5.5.2015 in Ghoshwari P.S. Case No.38 of 2014 for the offence under Sections 302 / 34 of the I.P.C.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution story, in short, is that on 22.5.2014 father of the informant was sleeping in the field just out of his house. At 12.30 O' clock when the informant on hearing sound of firing went near his father he saw him lying injured in pool of blood and two persons fleeing by horse. His father told him that they were Randhir Yadav and Sandhir Yadav along with 2-3 persons. The informant with the help of villagers took his father to Sadar Hospital where in course of treatment he died. Earlier

Patna High Court Cr.Misc. No.26105 of 2015 (2) dt.24-07-2015 2/2 altercation between the informant's father and the accused persons is said to be the reason behind the occurrence. It is submitted on behalf of the petitioner that he is in custody since 5.5.2015. The petitioner is not named in the F.I.R. He has been named in course of investigation by the wife of the deceased as one of the accused.

It has been submitted on behalf of the State that the petitioner's name has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Ashutosh Kumar, J.M. 1st Class, Barh, Patna, in Ghoshwari P.S. Case No.38/14.
