The petitioner is in custody in connection with Ghosi P.S.Case No.305 of 2015 registered for an offence under Sections 304(B) and 201/34 of the IPC.

As per the prosecution case, it is a case of murder of informant's married daughter, namely, Rubi Kumari by the accused persons due to non-fulfilment of demand of dowry. Learned counsel for the petitioner submits that petitioner is in custody since 01.04.2016. Charge-sheet has already been submitted in the case. Petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses against the petitioner. From perusal of paras-18, 19, 20 and 21 of the case diary, it is evident that all the independent witnesses have

Patna High Court Cr.Misc. No.20376 of 2016 (6) dt.04-08-2016 stated that the deceased died due to illness while she was being taken to Patna Medical College Hospital, Patna for treatment. The informant has filed a petition in the court below vide Annexure-2 stating that the present case has been instituted due to mistake of fact.

On behalf of the counsel for the Informant, it is submitted that Annexure-2 filed in the court below has been admitted.

On behalf of the State, it is submitted that the petitioner is the husband of the deceased.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Jehanabad in connection with Ghosi P.S.Case No.305 of 2015.
