Heard learned counsel for the petitioner and the respondents.

This application has been filed on behalf of the petitioners seeking direction to the respondents to issue licence for running Public Distribution System (for brevity, PDS) shop under Bihar Targeted Public Distribution System Control Order, 2016.

It is the case of the petitioners that after following due process of selection, they have been placed in the merit list for issuance of licence in their favour in respect of PDS shops for different Gram Panchayats. However, no licence is being issued in the light of an interim order dated 07.08.2018 passed by this Court in CWJC No 14135 of 2018.

Counter affidavit has been filed on behalf of the State

Patna High Court CWJC No.13931 of 2021(8) dt.20-05-2022 3/3 of Bihar wherein it has been admitted that due to interim order passed by this Court in CWJC No 14135 of 2018, no final selection list of candidates has been issued by the District Level Selection Committee. It has been stated in the counter affidavit that the petitioners should wait final outcome of CWJC No 14135 of 2018.

The said CWJC No 14135 of 2018 has been heard today by us and the same has been dismissed. The interim order dated 07.08.2018 passed by this Court in CWJC No 14135 of 2018 has been vacated by the judgment and order passed by us today.

In such view of the matter, this application is disposed of with a direction to the respondents to proceed further in accordance with law.
