JUSTICE MADHURESH PRASAD ORAL ORDER 03-11-2022 On a finding that the petitioner during his service from 1991 till 31.01.2008 has been declared as a deserter on five occasions and granted four major as well as five minor punishments. The Director General of Police (D.G.P. for brevity) has rejected the petitioner's mercy appeal by order dated 24.05.2021.

The fact is being noticed in view of the nature of submission advanced on behalf of learned counsel for the petitioner. He has drawn attention of the Court towards paragraphs VII, VIII and IX of his mercy appeal, which reads as follows:-

Patna High Court CWJC No.13948 of 2021(2) dt.03-11-2022 2/3 "VII. 17 ससाल सेवसा पूर्ण करनसे कसे उपरसान्त मुझसे सेवसा बरर्खास्तगगी जसे कठठोरतम सजसा दगी गयगी हज, जजसकसे कसारन मज सेवसा जनवृत लसाभ भगी नहहीं पसा सकतसा हपूह। सेवसा बरर्खास्तगगी कगी सजसा कठठोर एव disproportionate to the offence हज। VIII. मसेरसे जवरुद्ध मुख्य आरठोप 38 जदन अनमुपजस्स्थिजत कसा हज। ऐसे भगी मसेरसे जवरुद्ध आरठोप moral turpitude से सम्बवजधित नहहीं हज , अततः सेवसा बरर्खास्तगगी कगी सजसा कठठोर एव पमुजलस हस्तक जनयम-826 कसे प्रजतकपूल हज। IX. मज महसादजरद्र हपूह। मज पूर्णतयसा ननौकरगी पर हगी आधिसाजरत स्थिसा। सेवसा बरर्खास्तगगी कगी सजसा कसे कसारर मज तस्थिसा मसेरसा पूरसा पजरवसार भमुरमरगी कगी जशिकसार हठो गयसा हज। मज दयसा तस्थिसा सहसानमुभपूजत कसा पसात्र हपूह।"

It is submitted that while rejecting his mercy appeal the D.G.P. has not dealt with the said claim of the petitioner. In view of the limited submission, without expressing any opinion on the merits of the petitioner's claim, the Court would direct the Respondent No.2 to pass a reasoned and speaking order on the above noted claim of the petitioner. While passing a speaking order, earlier order dated 24.05.2021 shall
