JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Petitioner is languishing in custody since 10.10.2014 in a case initially registered for the offences punishable under Sections 392 of the Indian Penal Code, subsequently Sections 395,120(b) of the Indian Penal Code was also added.

The informant's Scorpio vehicle was robbed.

The name of the petitioner sprang up on confession of coaccused. A statement has been made in para 10 of the petition that nothing has been recovered from the petitioner nor the petitioner has been put on test identification parade. Considering the fact that petitioner has not been put on test identification parade, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.26136 of 2015 (2) dt.24-07-2015 2/2 each to the satisfaction of learned Additional Sessions Judge, V, Aurangabad in connection with Sessions Trial No. 54/2015/24/2015, arising out of Aurangabad Muffasil P.S. Case No. 296 of 2013.

Since the petitioner has serious criminal antecedent, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in some serious nature of offence or defaults for three consecutive occasions during trial.
