JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioners are apprehending their arrest in a case registered in connection with Sahar P.S.Case No. 281 of 2020 for the offences punishable under Sections, 323, 341,354, 504/34 of the Indian Penal Code.

It is a case of assaulting the outrage the modesty of informant's daughter. When informant's son came to rescue his family, co-accused persons assaulted him with lathi, in which he sustained injury on his head.

Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.44546 of 2021(3) dt.24-03-2022 2/2 petitioners have falsely been implicated in this case. No specific allegation of assault levelled against the petitioners. F.I.R has been lodged after 20 days of occurrence. Petitioners have clean antecedent.

Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioners in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VI, Bhojpur at Ara Purnea in connection with Sahar P.S Case No. 281 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U
