The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 324, 308/34 of the Indian Penal Code. The prosecution case in nutshell is that all the accused persons including petitioner, variously armed, came and started assaulting the informant.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in the present case. There is no specific allegation levelled against the petitioner. The specific allegation of assaulting is against Guriya Devi, who is the

Patna High Court CR. MISC. No.35154 of 2022(2) dt.28-11-2022 2/2 daughter of the petitioner. It is also submitted that both parties are agnates and there is dispute between the parties regarding the partition of land.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/ concerned Court, Banka in connection with Banka P.S. Case No. 629 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
