JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Heard the learned counsel for the petitioner as well as the learned for the State.

The petitioner is languishing in custody since 03.02.2015 in a case registered for the offences punishable under sections 454, 380, 411 and 307 of the I.P.C, and sections 25 (1-B) a, 26 and 27 of the Arms Act.

It is alleged that while the informant was at his house he heard some sound while coming out from the house and saw a person fleeing away with briefcase and on protest the miscreant fired upon the informant by country made pistol but with the help of local people the petitioner was caught who disclosed his name as Sanjay Kumar and from his possession a country made pistol, one

Patna High Court Cr.Misc. No.26151 of 2015 (2) dt.27-07-2015 2/2 cartridge and a mobile phone were recovered.

It is submitted by learned counsel for the petitioner that the petitioner and the informant were on litigating terms from before hence accusation has been levelled against the petitioner maliciously. The recovery has been claimed to be made by informant who produced the petitioner before the police. Statement has been made in paragraph no. 3 of the petition that petitioner has no criminal antecedent.

Considering the fact that investigation has concluded, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Aashish Mishra, J.M. 1st Class, Gopalganj in Bhorey P.S. Case No. 13 of 2015.
