2. This application has been filed to command the respondents to comply the order dated 08.11.2016 passed by the Collector, Supaul in Memo No. 1632-2.

3. Petitioner is the brother of the encroacher, namely, Surendra Yadav who has lost the Encroachment Case No. 05 of

Patna High Court CWJC No.9029 of 2023(2) dt.23-11-2023 2/2 2020 and also in Appeal No. 02 of 2021 in the District of Supaul . Now, petitioner is pursuing this proxy litigation having no locus.

4. In view of the aforesaid facts, this application is dismissed with cost of Rs. 10,000/- (Rupees Ten Thousand Only). The petitioner will deposit the said amount in District Legal Services Authority, Supaul within one month from the date of receipt/communication of a copy of this order.

5. If the petitioner does not deposit the said amount in District Legal Services Authority, Supaul, the District Magistrate will recover the same from the petitioner.

6. Let a copy of this order be communicated to the District Magistrate, Supaul for its compliance through FAX and e-mail forthwith.
