JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 The petitioner is in custody since 18.2.2015 in Manpur P.S. Case No.18 of 2015 for the offences under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379, 504, 506 of the I.P.C. and Section 27 of the Arms Act.
Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that while the informant on 17.2.2015 was getting the earth cut in his house the petitioner along with other accused persons came there and surrounded the informant and at instigation of Ashok Yadav the petitioner opened fire causing injury near ankle of the right leg of the informant and he fell down and all the accused persons committed theft of gold and Rs.50,000/- cash.
Patna High Court Cr.Misc. No.26110 of 2015 (2) dt.24-07-2015 2/2 It has been submitted on behalf of the petitioner that he is in custody since 18.2.2015 and charge sheet has already been submitted in this case. The petitioner has no criminal antecedent. The petitioner is said to have fired causing injury on non-vital part of the body, i.e. leg.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Nalanda at Biharsharif, in Manpur P.S. Case No.18/15.
