The petitioner is accused in connection with Pauthu P.S. Case No. 06 of 2016, registered under Section 302, 328/34 of the Indian Penal Code.

The prosecution case is that the marriage of the daughter of the informant was performed with this petitioner in the year 2001 and there are three children out of their wedlock. The petitioner used to assault the daughter of the informant. On 09.02.2016 an information was received by the informant through the petitioner regarding illness of his daughter, when informant went there then saw froth was coming out from the mouth of his daughter, which indicates about administering of poison. She was rushed for treatment, but she died on the way.

No.19299 of 2016 (2) dt.05-05-2016 2/2 Learned counsel for the petitioner submits that it would appear from the F.I.R. that wife of the petitioner died after the15 years of the marriage and regarding illness of his wife, the information was also given to the informant, father of the deceased, by this petitioner. Further submission is that Police has already submitted Chargesheet under Section 306 of the I.P.C. and the petitioner is in custody since 10.02.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-II, Aurangabad connection with Pauthu P.S. Case No. 06 of 2016.
