JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 304(B) and 201/34 of the Indian Penal Code. Petitioner happens to be mother-in-law of the deceased and is languishing in jail custody since 5.1.2016. From perusal of the first information report, I find that on 2.10.2015, the deceased was at her parental home and her husband went there and took her along with him. Subsequently, on 5.10.2015, the dead body of the deceased was recovered, so even if the written report of the informant assumed to be true, then also the entire circumstantial evidence points out finger towards the husband of the deceased.

No.20280 of 2016 (2) dt.09-05-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Arrah in connection with Narayanpur P.S. Case No.67 of 2015.
