The petitioner seeks bail in Sangrampur P.S. case No. 79 of 2014, corresponding to Sessions Trial No. 284/ 2016, under Section 304B and other sections of the Indian Penal Code. The learned counsel for the petitioner submits that prayer of petitioner for bail was earlier rejected by this court vide order dated 07.09.2015 passed in Cr. Misc. No. 21324 of 2015 with a direction that if the trial is not concluded within nine months the petitioner may renew his prayer for bail. It appears that petitioner is the husband and there is allegation against him that he killed his wife. The petitioner has remained in jail only about two years.

Patna High Court Cr.Misc. No.19332 of 2016 (4) dt.26-10-2016 2/2 Considering the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

The trial court is directed to hold the trial on day to day basis and conclude the same within nine months from the date of receipt of this order.

The Superintendent of Police, East Champaran at Motihari is directed to ensure the attendance of prosecution witnesses of Sangrampur P.S. case No. 79 of 2014, corresponding to Sessions Trial No. 284 of 2016, in the court of learned 14th Additional Sessions Judge, East Champaran at Motihari so that the trial must be concluded within nine months.
