The petitioner seeks bail in Madanpur P.S. Case No.12 of 2020, registered under Sections 399, 402, 386 and 387 of the Indian Penal Code, under Sections 25(1-b)a/26/35 of the Arms Act as well as under Section 17 of the C.L.A. Act. The informant got information that some persons had assembled at the house of Dashrath Yadav for committing cognizable offence and, on such, the police raided the house of Dashrath Yadav. Four persons including the petitioner, Sunil Chandrawanshi were apprehended. On search, two live cartridges and one leaflet said to be of banned organization were recovered from possession of the petitioner.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.33381 of 2020(2) dt.16-12-2020 2/2 petitioner is in jail since 20.01.2020. Similarly situated other accused persons, namely, Dashrath Yadav and Malkhan Singh have already been granted bail by different Benches of this Court.

Taking into consideration the facts that of course the petitioner has got criminal antecedents but he is in jail for the last 11 months for recovery of two live cartridges and one leaflet said to be of banned organization, petitioner, namely, Sunil Kumar Chandrawanshi is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad (Bihar) in connection with Madanpur P.S. Case No.12 of 2020.
