The petitioner seeks bail in Muffasil P.S. Case No. 238 of 2020, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner and coaccused Ajay Singh are alleged to have caused firearm injury upon the father of informant causing injury on his left hand and chest.
It is submitted on behalf of the petitioner that after investigation the police submitted chargesheet vide chargesheet no. 52 of 2021 dated 08.03.2021 under Section 307 and other allied sections of the IPC and section 27 of the Arms Act against petitioner and no complicity of co-accused Ajay Singh and others were found in this case and investigation with respect to
Patna High Court CR. MISC. No.44039 of 2021(2) dt.01-11-2021 2/2 co-accused Pramod Singh is kept pending. It is further submitted that petitioner has been falsely implicated in this case case due to previous enmity. Both parties are agnates. In fact, dispute arose on the point of playing DJ and when the petitioner and family members forbidden to play DJ, the informant did not pay heed to them. Petitioner is in custody since 15.12.2020 having clean antecedent.
Considering the facts and circumstances of the case and clean antecedent, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Muffasil P.S.
