JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Petitioner No. 1 being husband of the victim and petitioner No. 2 being father of petitioner No. 1 are languishing in custody since 05.08.2014 and 19.08.2014 in a case registered for the offences punishable under Section 304(B)/34 of the Indian Penal Code.
The accusation is killing the grand-daughter of the informant after seven years of marriage by hanging to the victim.
It is submitted by learned counsel for the petitioners that informant has not supported the accusation during trial and he has been declared hostile. The maternal aunt of the victim has also not supported the accusation. Considering the aforesaid facts, let the petitioner No. 2, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned
Patna High Court Cr.Misc. No.26248 of 2015 (2) dt.27-07-2015 2/2 District & Sessions Judge, Kishanganj in connection with Sessions Trial No.
of 2015, arising out of Dighalbank(Korhobari) P.S. Case No. 94 of 2014. So far as petitioner No. 1 is concerned, this Court is not inclined to grant bail to the petitioner No. 1 at present. It is expected from learned Trial Court to conclude the trial within a period of five months.
Accordingly the application with regard to petitioner No. 1 stands disposed off.
