Petitioner is languishing in custody since 20.03.2015 in a case registered for the offences punishable under Sections 363, 366A of the Indian Penal Code. Accusation is of kidnapping the minor daughter of the informant.

It is submitted by the learned counsel for the petitioner that under Section 164 Cr.P.C. statement the victim got her age recorded 19 years, the Court also assessed her aged 17 years but during medical examination of the victim the Doctor found her age between 15-17 years. The victim has stated that her mother wanted to marry her with some other boy whom she did not like, as a result she of her own married with the petitioner.

Patna High Court Cr.Misc. No.26272 of 2015 (2) dt.27-07-2015 Considering the statement under Section 164 Cr.P.C. of the victim and the investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 139 of 2015.
