JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case registered under Sections 457,380 and 411 of the Indian Penal Code. Accusation is that there was theft of ornaments, 30 Sarees, two ATM card and pass book in the house of the informant by unknown persons.

Submission of learned counsel appearing on behalf of the petitioner is that the name of the petitioner has surfaced in this case on the basis of confessional statement made by the petitioner in another case. So far recovery of 12 Sarees and some ornaments from the house of the petitioner is concerned, no theft Sarees and ornaments are recovered from the house of the petitioner. Further submission is that after apprehending by the

Patna High Court Cr.Misc. No.19431 of 2016 (2) dt.06-05-2016 2/2 police in the present case he was remanded in Chand P.S.Case No. 04 of 2016 and in the present case the petitioner is in custody since 6.2.2016.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua in connection with Chand P.S.Case No. 05 of 2016.
