JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 The petitioner is in custody since 13.3.2015 in Buxar Nagar P.S. Case No.117/15 for the offences under Sections 147, 148, 149, 341, 323, 332, 337, 338, 307, 353, 427,435 and 325 of the I.P.C.
Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that the when the informant was on patrolling duty in the evening of 11.3.2015 received message by police station that severe accident had taken place in which truck dashed motorcycle and other vehicles as a result of which many persons received fatal injuries whereas some persons had died. The informant rushed to the place of occurrence where he saw dead bodies and injured who were taken to the
Patna High Court Cr.Misc. No.26077 of 2015 (2) dt.24-07-2015 2/2 hospital for treatment as well as 400-500 people variously armed with weapons and setting fire to the truck. People pelted stone on the police personnel and after setting the vehicle on fire they fled away.
On behalf of the petitioner it has been submitted that he is in custody since 13.3.2015 and charge sheet has already been submitted in this case. It is submitted that there is no specific overt act against the petitioner rather there is general and omnibus allegation against altogether 45 named accused persons. It has been submitted on behalf of the State that the petitioner has been named in the F.I.R..
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M. Buxar, in Buxar Nagar P.S. Case No.117/15.
