2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks regular bail in connection with Inarwa P.S. Case No. 29 of 2023 registered on 19.03.2023 lodged under Sections 341, 323, 324, 307, 354B, 315, 379, 380, 427, 447, 448, 504, 506 and 34 of the I.P.C.

4. As per the prosecution case, F.I.R. has been lodged against seven named accused persons, including the present petitioner, who assaulted the informant.

5. Counsel for the petitioner submits that petitioner and informant sides are well known to each other and basically

He further submits that from the same date, place and time of occurrence, two F.I.Rs. were lodged, one from the Informant's side and another from the petitioner's side. The case no. of Informant's side is Inarwa P.S. Case No. 29 of 2023 and the case no. of Petitioner's side is Inarwa P.S. Case No. 30 of 2023

Counsel further submits that petitioner is innocent and has committed no offence and from the content of the F.I.R. it transpires that the cause of dispute is throwing of dust in front of the house. Counsel submits that there is a case and a counter case from both the sides and all injuries are simple in nature. He further submits that petitioner is in custody since 20.03.2023 having one criminal case pending against him, in which he is on bail and charge-sheet has already been filed in this case.

7. Learned counsel for the State opposes the prayer for bail.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, West Champaran, Bettiah in connection with Inarwa P.S. Case

Patna High Court CR. MISC. No.36449 of 2023(2) dt.24-06-2023 3/3 No. 29 of 2023, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

9. With this observation, the bail application stands allowed.
