JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Petitioner is languishing in custody since 02.03.2015 in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

One loaded pick up van was robbed leading to registration of the First Information Report against coaccused Pradeep and three unknown. Subsequently on the confession of co-accused Niraj Kumar Sinha the stolen articles were recovered when Niraj Kumar Sinha confessed that he handed over the said vehicle along with stolen goods to the brother of the petitioner.

It is submitted by learned counsel for the petitioner that recovery was not made from the possession of the petitioner.

Moreover the investigation has already concluded.

Patna High Court Cr.Misc. No.26167 of 2015 (2) dt.24-07-2015 2/2 A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 86 of 2015.
