The petitioner seeks regular bail in connection with Special Case No.3498 of 2019 arising out of P.R. P.S.Case No.191 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 . Allegation against the petitioner is about recovery of 16 ltrs. of liquor from the possession of the petitioner. Submission of the learned counsel for the petitioner is that he is 65 years old, falsely implicated in this case, having no criminal antecedent and he is in custody since 1.4.2019 as well as he is ready to abide by any condition imposed upon him. Heard learned A.P.P. also.

No.34109 of 2019(2) dt.23-05-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No.3498 of 2019 arising out of P.R. P.S.Case no.191 of 2019.

With the aforesaid observation, this application is allowed.
