Petitioner seeks bail in a case registered under section 414/34 of the Indian Penal Code.
According to the prosecution case on 14.04.2015 the police party during the patrolling met with a suspect person who stated his name Nihal Kumar @ Akash Kumar after interrogation he told that he had come here for committing theft of motorcycle and stated that he along with his friend Dilip Kumar Singh used to commit theft and after committing theft he gave it to one Rahul who used to give them money. On behalf of the petitioner it is submitted that petitioner is in custody since 05.04.2015 and charge sheet has
Patna High Court Cr.Misc. No.29363 of 2015 (2) dt.05-08-2015 2/2 been submitted. He has no criminal antecedent. Petitioner denied the allegation of recovery of motorcycle from his conscious possession.
On behalf of the State it is submitted that petitioner is named in the first information report. Considering eh aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/ (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in Brahampura P.S. Case No. 103 of 2015.
