The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30(a)/38 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner. It is stated in para-11 of the bail petition that the registration number of petitioner's tractor bearing Registration No. BR24G-4100 has not been mentioned in the First Information Report neither the Chesis No. ONPDP263 and Engine No. NPDP263 have been mentioned and the Chesis bearing No. 00650528801 is the general number and tractor is not concerned with the said

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-IInd-cum-Special Judge, Excise, Rohtas, Sasaram in connection with Suryapura Police Station Case No. 102 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
