JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-01-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Goh P.S. Case No. 37 of 2012 for the offence under Sections 147, 148, 149, 341, 323, 434, 427 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of C.L.A. Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 24.07.2019.

It is alleged that petitioner was a member of the extremist organization and he was among 50 unknown persons who were involved in putting the vehicles and generator kept in the camp of the Company on fire for non-fulfillment of levy to the extremist organization. The name of the petitioner surfaced

Patna High Court CR. MISC. No.34846 of 2020(2) dt.25-01-2021 2/2 on the basis of the confessional statement of co-accused Mritunjay Mishra.

Considering the fact that the petitioner has no criminal antecedent and he is in custody since 24.07.2019, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Goh P.S. Case No. 37 of 2012, subject to the condition that the bailors should be elected representatives including the local Mukhiya.
