JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 143, 341, 323, 342, 307, 302, 448, 447 and 380 of the Indian Penal Code.
Altogether, 14 persons including the petitioner have been made accused in this case and it is alleged that all the accused went at the house of the informant and started assaulting the inmates of the house including the informant as well as his mother. There is specific allegation against the petitioner that he gave farsa blow on the head of the informant. So far as deceased is concerned, it is specific case of the informant that it was co-
Patna High Court Cr.Misc. No.20298 of 2016 (2) dt.09-05-2016 2/2 accused Uday Rai, who assaulted the deceased. Learned counsel for the petitioner submits that as a matter of fact, free fight took place between both the parties and both sides lodged cases against each others. It is further submitted that the informant has sustained simple injury, which has specifically been pleaded at paragraph-8 of the petition. Petitioner is in jail custody since 17.12.2015 and does not have any criminal antecedent.
Moreover, taking note of the nature of allegation levelled against the petitioner as well as the previous character, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate III, Vaishali at Hazipur in connection with Bhagwanpur P.S. Case No.281 of 2015.
