JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Char Pokhari P.S. Case No. 230 of 2018 registered for the offences punishable under Sections 147, 149, 323, 307 and 379 of the Indian Penal Code.

Allegation against the accused persons, including the petitioner is that they surrounded the informant and assaulted him and there is specific allegation against the petitioner that he assaulted by means of rod on the head of the informant, causing injury to him.

Submission of learned counsel for the petitioner is that though informant has appeared in court below but he has not stated anything about the nature of injury and also impugned order does not disclose anything about the injury. Further submission is that there is enmity between the parties and cases

Patna High Court CR. MISC. No.32608 of 2019(2) dt.29-07-2019 2/2 are going on.

Heard learned APP also.

In view of above facts and circumstances, this application is disposed of with direction to court below to call for the injury report as well as opinion on injury report and if it is found that injuries are simple in nature, on appearance of the petitioner he will be released on bail to its own satisfaction, otherwise petitioner has to surrender and pray for regular bail.
