JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bhorey P.S. Case No. 206 of 2012 registered under Section 302 and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that prayer for bail of the petitioner was rejected twice vide Criminal Miscellaneous No. 31850 of 2013, dated 11.02.2014 and Criminal Miscellaneous No. 43615 of 2014, dated 28.01.2015. At the time of the rejection of prayer of the petitioner in Criminal Miscellaneous No. 43615 of 2014, dated 28.01.2015 the direction was given to the trial Court to conclude the trial of the petitioner within six months giving liberty to renew his prayer for bail in case of non-conclusion of trial within the aforesaid period. Now,

Patna High Court Cr.Misc. No.20129 of 2016 (2) dt.11-05-2016 2/2 more than one year has been elapsed, but up till now only 09 prosecution witnesses have been examined and the petitioner is in custody since 30.01.2013.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.3rd, Gopalganj in connection with Bhorey P.S. Case No. 206 of 2012.
