Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 376, 341, 504, 34 of the Indian Penal Code. Allegation against the petitioner is of establishing physical relation with the victim on the false pretext of marriage and ultimately, refused to marry with her.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 28-03-2019. On the false pretext

Later on, the petitioner is alleged to have refused to marry with the victim. The allegation, made in the FIR is denied by the petitioner. The medical report does not support the allegation made in the FIR.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Kishanganj in connection with Kishanganj Mahila P.S. Case No. 60 of 2018.
