JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-10-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named with accusation that they along with one accused mercilessly assaulted the deceased with lathi and danda but no apparent and visible injury was found on the person of the deceased at the time of post mortem examination. Learned counsel for the petitioner submits that the Deputy Superintendent of Katihar Medical College, Katihar issued death certificate of deceased and in the aforesaid certificate, the concerned officer mentioned the cause of death as intestinal destruction and septicemia.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.28094 of 2015 (3) dt.13-10-2015 2/2 well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Baisi P.S. Case No. 48 of 2015.
