The petitioner seeks bail in connection with Kahalgaon (Shiv Narayanpur) P.S. Case No.353 of 2014 for the offence punishable under Section 395 of the Indian Penal Code. The prosecution story, in brief, is that the petitioner along with others made the informant captive by tying his hands with towel, snatched his Nokia Mobile and a sum of Rs.1000/- cash and took away his tractor.

It has been submitted on behalf of the petitioner that no incriminating article has been recovered from the possession of the petitioner Further it has been pointed out that other accused persons, namely, Bittu Kumar and Amar Kumar, have been granted bail by this Court vide Cr.Misc.No.46791 of 2014 and Cr.

Patna High Court Cr.Misc. No.26367 of 2015 (2) dt.11-06-2015 2/2 Misc. No.4716 of 2015, respectively. It is further submitted that the petitioner is in custody since 29.04.2015. On behalf of the State, it has been submitted that the petitioner is named in the first information report. Considering the fact that other accused persons have been granted bail by this Court, let the petitioner, above named, be also released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to Sri Anwar Samim, Judicial Magistrate, Ist Class, Bhagalpur in connection with Kahalgaon (Shiv Narayanpur) P.S. case No.353 of 2014.
