The victim returned her home safely and after one and half month from the date of her return, statement of victim under section 164 of the Cr.P.C has been recorded.

No doubt, in her statement, victim stated that she was taken away by the petitioner but the statement of victim recorded under section 164 of the Cr.P.C reflects that there was love affair between the victim and the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Sour Bazar P.S.
