The petitioner seeks bail in a case under Section 379/411 of the Indian Penal Code and under section 25(1-b) a 26(i), 35 of the Arms Act.

The motor cycle of the informant was stolen. He came out from his house on hearing barking of a dog. The informant saw three persons standing with motor cycle in an orchard. The informant disclosed the number of stolen Apache motor cycle as BR-10/3483 but the motor cycle recovered from the possession of accused persons including the petitioner is of different number. The petitioner is said to have disclosed that he stolen the motor cycle from a different place. The petitioner is in jail since 14.07.2014 and he got one case of Arms Act pending

Patna High Court Cr.Misc. No.28661 of 2015 (2) dt.06-08-2015 2/2 against him.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Mousmi Singh, learned Judicial Magistrate, 1st class, Munger in Asarganj P.S. Case No. 59/2014. (Prabhat Kumar Jha, J) BKS/- U T
