JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 19-01-2021 Heard learned counsel for the petitioner, informant and learned Additional Public Prosecutor for the State. The petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
Petitioner in association of his family members is said to have tortured the daughter of the informant and lastly killed her on non-fulfillment of demand of dowry.
Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that petitioner is the husband of the deceased and he was in private job for his livelihood at Punjab since 2017 and upon receiving information with respect to death of his wife, he came at home on 19.06.2020 due to complete lock
Patna High Court CR. MISC. No.32659 of 2020(3) dt.19-01-2021 2/2 down whereas the FIR is of 07.04.2020. He submits that police after investigation submitted final form against the petitioner under Section 306 of the Indian Penal Code. He further submits that petitioner is languishing in judicial custody since 12.07.2020.
Learned counsel for the informant submits that petitioner is not present at the time of occurrence. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Ganga Bridge Police Station Case No. 29 of 2020.
