Case No. 4 of 2015 for the offence instituted under Section 376 (D) of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that there is accusation against the petitioner including co-accused persons of committing rape upon the informant and assaulting her. It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.4.2015 and the charge sheet has submitted in the present case. He has no criminal antecedent. The victim girl in her 164 Cr.P.C. statement has herself admitted that she had gone out with the petitioner at her own will. There is no

Patna High Court Cr.Misc. No.26218 of 2015 (3) dt.12-08-2015 2/2 allegation of any abduction against the petitioner. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Munger, in connection with Munger Mahila P.S. Case No.4 of 2015.
