The petitioner seeks bail in connection with Sahajitpur P.S. Case No. 34 of 2019 instituted for the offence under Section(s) 30, 30(A) of Bihar Prohibition & Excise Act, 2016.

Learned counsel for petitioner has submitted that there is no recovery of any illicit liquor from possession of this petitioner. Petitioner has not been apprehended on the spot. It is mentioned in the written report that four persons fled away after leaving the motorcycle after seeing the police party. Police recovered illicit foreign liquor from the aforesaid motorcycle. The motorcycle belongs to one Vivek Kumar Singh. The police searched the house of Vivek Kumar Singh and seized illicit

Patna High Court CR. MISC. No.35528 of 2019(3) dt.26-06-2019 2/2 liquor from his house. It is further alleged that police also made search of the house of this petitioner but no recovery of any illicit liquor has been made from house of petitioner. Petitioner is in custody since 22.4.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise Act), Saran in connection with Sahajitpur P.S. Case No. 34 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
